At DominaLaw Group pc llo, we employ a value-based billing philosophy. What do we mean by this? Our firm provides our services on a contingent basis or through unit billing, depending on the type of case. If we are serving to recover funds for a client, we will share the costs of litigation on a percentage fee basis. We only get paid if you do. For other types of cases, we utilize unit billing based not upon hours spent but on specific factors we use to establish reasonable fees, including the complexity, skill and sensitivity of the matter at hand. In both types of billing, we work to serve the client's best interests.
There are a number of benefits to be experienced by using contingency fees, and we are able to employ this method of accounting in a number of areas of business litigation. In disputes where our client serves to recover financial compensation, we may be able to handle the case on a contingent fee basis. For example, in a case alleging securities fraud, in a class action lawsuit filed by consumers against a manufacturer or in a case alleging financial losses caused by professional negligence, we may be able to forward legal costs and only recover our fees if we win the case on our client's behalf through a settlement or jury award.
The Benefits of Contingent Fee Arrangements
Contingent fee arrangements serve to align the interests of the client and the attorney in a legal matter. The client and attorney already share the common goal of resolving the case as swiftly as possible and to the best result, while keeping expenses low. Linking legal fees to compensation recovered by the client gives the attorney even more incentive to resolve the matter quickly and to recover as much compensation as possible. The attorney has no incentive to drive up litigation costs and instead works out the most cost-effective method of investigating the matter and building a compelling case without sacrificing results. Sharing the risk with the client creates a strong drive in the attorney to work diligently on the client's behalf.
How does it work? What percentage will you take?
Although fees may vary in special circumstances, the following will usually apply in commercial litigation paid through contingency fees. Our regular fee is 25% of the amount received before the suit is filed or within 45 days thereafter; 33 1/3% of amounts recovered thereafter, and if an appeal occurs, 40% of sums received. Disbursements must be reimbursed by the client.
